Terms & Conditions

1. All vehicles sold to consumers are compliant with the Consumer Rights Act 2015.

2. Deposits taken to reserve a car are non-refundable in all cases.

3. All vehicles are warranted free from defect for a minimum of 3 months following the day of purchase. Additional warranty cover is available for 12 months, 24 months and 36 months at additional cost.

4. All vehicles are sold in good faith.

5. Hartington Motors cannot guarantee that any vehicle will be wholly compliant with its description (either published or given verbally). The customer is always advised to carry out checks for themselves before buying.

6. All vehicles undergo a comprehensive quality check before sale, and where appropriate, will be serviced and provided with a new or current MOT test certificate.

7. All vehicles purchased on finance will remain the property of the finance company unless alternative purchase terms are agreed, or until the finance balanced has been cleared.

8. 'Full Service History' denotes a history of all the services undertaken on that vehicle. It neither implies nor warrants that all services have been carried out, or carried out on time or to the required standard.

9. For an additional fee, Hartington Motors will undertake a major service for a purchasing customer at their request prior to delivery.

10. For an additional fee, Hartington Motors will replace all drive belts for a purchasing customer on request (unless the belts are new).

11. No repairs or diagnostics may be undertaken while the vehicle is within the warranty period, without the prior consent of Hartington Motors. Unauthorised repairs can void your warranty.

12. Hartington Motors will not be responsible for the cost of any repairs or diagnostics not previously authorised by them.

13. Title to the goods passes only upon receipt in cleared funds of the final payment due.

14.It is a condition of any sale that the purchaser ensures the vehicle is fully and properly insured before taking it on the highway.

15. These terms and conditions may be amended without prior notice from time to time.

16. Any holding deposits will take 7-10 working days to be processed and refunded.

Cancellation under the Distance Selling Regulations

17. Ordinarily we do not run an organised distance selling scheme.

18. However, due to the coronavirus outbreak we need to support our valued customers by delivering your vehicle to your home.

19. If you have ordered and taken delivery of your vehicle without visiting our showroom and you are not buying the car in the course of your trade or business, the following cancellation clause applies:

• You have 14 days to get to know your new vehicle and to make sure it suits you. If you change your mind just let us know by email to [email protected]. Reach us by 6pm on the 14th day following delivery and we will come and collect the vehicle for a refund.
• To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement sent by email to [email protected]. To meet the cancellation deadline, it is sufficient for you to send your clear statement or form concerning your exercise of the right to cancel before the cancellation period has expired.
• We cannot accept a return of the car if it has been damaged, modified or altered from the condition it was delivered in.
• An excess mileage charge of £1 per mile for any mileage over 15 miles in those 14 days will apply. If you do change your mind you cannot use the car once you have notified us - but you must still tax and insure your vehicle until it is collected.
• If you cancel this contract, we will reimburse to you payments received from you, including the cost of delivering the goods to you, (except for the supplementary costs arising if you chose delivery over collection or a type of delivery other than the least expensive type of standard delivery offered by us). This reimbursement is subject to the following conditions.
• We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you. Anything over and above a standard test drive will be considered unnecessary handling and will lead to a deduction of £1 for each mile driven over 15 miles. In addition we will also be entitled to make a deduction for any damage or excess wear in addition to a administration fee.
• We will make the reimbursement without undue delay, and not later than 14 days after the day we receive back from you the vehicle and all documents which were supplied including but not limited to service histories and the V5 documentation.
• We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. This may include handing back any part exchange vehicle, if still available and/or seeking payment from you to cover any negative equity.
• We will withhold the reimbursement until we have received the goods and all paperwork back in good order.
• It is your responsibility to return the vehicle without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of this contract to us.
• You will remain liable for the vehicle and so for its tax, insurance and any fines, charges or penalties until it has been accepted back to our premises.
• You will have to bear the direct cost of returning the goods and take full responsibility for the safe return of the vehicle. If you require us to collect it the cost to you will be £1.50 plus VAT per mile.
• You are only liable for any diminished value of the goods resulting from the handling other than which is necessary to establish the nature, characteristics and functioning of the goods according to the previous reference to test drives.

20. This cancellation (change of mind) clause does not affect any separate rights given to you in The Consumer Rights Act 2015 or the Sale of Goods Act 1979 (as amended).
